What is the GDPR exactly?

As of May 2018, explicit consent will have to be given to access the information people give to companies. Under the new rules, companies will no longer be able to use long terms and conditions that don’t explicitly inform the user and request their consent clearly. Failure to clearly demonstrate consent as outlined in these new guidelines will result in fines. Also, all companies will have to notify data breaches to the relevant authority within 72 hours of first becoming aware of the breach. The main goal of the new legislation is to strengthen data privacy and the rights of EU citizens online.

How will it work in practice?
Changes under GDPR will impact how companies work in a number of ways. A data processing officer (DPO) will be required for all the main activities in regulating and overseeing data. DPOs will be the driving figures behind the fostering of a data protection culture within companies and organisations. Any company that processes personal information will need to appoint or delegate one. Also, Privacy Impact Assessments, which is a tool companies can use to collect data, are going to be made mandatory under the GDPR. The legislation applies to all businesses in the EU and even to non-EU organisations that process any data from EU citizens.

The way marketing activities and data permission are managed are set to change. In practice, companies will have to make sure that a person wants to be contacted by including an opt-in on sign ups. This means that you can no longer assume people want to be contacted. For example, you won’t be able to automatically sign visitors up for emails when they fill out a web form.

The customer must understand what they have consented to, without any hidden details, and companies must tell people they have the right to withdraw their consent. Consent requests must be separate from other terms and conditions, with an explicit action to opt-in. In short: Consent must be obvious, unbundled and user-friendly. The point is that people must have an ongoing choice for how their data is managed.

How do you prepare your business for GPDR?

Firstly, you need to review your company’s documentation, assess what data you hold, where it came from via an information audit. You should also update any procedures so that they comply with the guidelines. Likewise, any contracts your organisation has with any third parties should be reviewed. Under the GPDR, an individual has the right to request that their data be erased – therefore, the procedure for dealing with such a request must be put in place. This is the case for both employees and customers who use your online services. It’s critical that you make sure you have the right tools to detect a data breach, as well as hiring a DPO.

Also, you need to make sure that all the key figures in your business understand how to process data in the proper way, as the company can be fined otherwise. Fines can be as high as €20 million or four per cent of a company’s global turnover. During your preparation, it’s important know that you must not send emails to your customers asking for consent, as the message itself is marketing. Flyby learned this the hard way when they were fined 70,000 in August 2016 by the ISO for unsolicited communications. The penalties for this type of data breach will be far heavier under the GDPR.

Q: So from my understanding this is a family business, right? How did this company get started?

A: This company was started in January 2001, post 9/11 terrorist attack. My father was a doorman at a busy hotel in downtown Los Angeles and my mother worked for LA Times, at the time. After the 9/11 terrorist attacks, my father who worked at a busy tourist hotel was laid off due to sudden stop of tourist traffic and at the same time, my mother was laid off due to LA Times consolidating their work force.

My father always wanted to work for himself so he went out, bought a tow truck and became self-employed, starting what was known as JP Towing, at the time. My mother, my brothers and I all helped my father work and transport vehicles for much of the early stages in this business. We were all involved and worked many hours with my father as he tried to sustain the business. The business started out with one tow truck and since then, has grown to a fleet of car carriers and a large network or partner car shipping companies.

Q: How has the family business changed since the early days? How have you changed it since taking over?

A: This business is always evolving and becoming larger every day. We started out as a company which only serviced local dealerships but we have grown to become an industry leader in vehicle shipping services and we now accommodate customers across the country and are able to help coordinate vehicle shipping needs for corporate and private clients all over the United States.

Q: What are all the services you offer and what is your most popular service?

A: We offer local and nationwide car shipping services. The transportation and logistics industry doesn’t typically have the younger generation interested in it, so my opportunity lies in being young and having lots of time to be able to make an impact and have an influence on the processes and future of the industry. Streamlined processes, creative ideas, modern technology and implementation of new systems are all major opportunities for someone as young as me. I’m 30 years old and I’ve been part of the auto transport industry since I’ve been 14 years old. I have the ambition, knowledge and desire to become a major player in this industry and that’s what I’m working towards now. Never any difficulties, only opportunities.

Q: A lot of transportation services are looking into self driving vehicles. Do you believe that can transform your industry as well? Would you ever consider it?

A: Something that my mentors have taught me is that a business must always evolve with technology and its customers in order to survive and thrive. If self-driving vehicles begin to have an impact on our industry, that’s clearly something I’ll have to explore. At the moment though, I like to focus on the present and I like to build on what can have an effect on my company NOW. It’s very important to look into the future and prepare for what might come next but it’s equally important to seize the moment NOW and try to have an influence on what you’re able to control TODAY.

Q: What is the long-term vision you have for this business?

A: The long-term vision I have for this company is to become a world-wide solution for vehicle shipping services. I’m working to become the largest car shipping company in California, then the United States and eventually the world. The ultimate goal is to take this company public at some point.
